How to Register a Trademark in Nigeria

Published on: 2023-02-20

A trademark is a recognizable sign, design, or expression which identifies products or services of a particular source from those of others. Registering your trademark in Nigeria provides you with exclusive rights to use it and protects you from infringement.

Steps to Trademark Registration:

  1. Trademark Search: Conduct a search at the Trademark Registry to ensure your proposed trademark is not already in use or too similar to an existing one.
  2. Application Filing: Submit your application to the Registrar of Trademarks. This includes details of the trademark, the goods/services it covers (classified under Nice Classification), and applicant information.
  3. Acceptance and Advertisement: If your application is accepted, it will be advertised in the Trademark Journal for a period (usually two months) to allow for any opposition.
  4. Opposition Period: During this period, any third party who believes your trademark infringes on theirs can file an opposition.
  5. Certificate of Registration: If there's no opposition or if the opposition is resolved in your favor, the Registrar will issue a Certificate of Registration.

Trademark registration is crucial for brand protection and can significantly increase the value of your business.
